1. Who We Are and What This Policy Covers

This Privacy Policy explains how Joshua Tree Distilling Company, LLC (“JTDC,” “we,” “us,” or “our”) collects, uses, and shares personal information when you visit our website at www.joshuatreedistillingco.com, participate in our Founding Member Campaign, make a purchase, join our email list, or otherwise interact with us online. By using our website or participating in the campaign, you agree to the practices described in this Policy.

2. Information We Collect

Information you provide to us:

  • Contact and order details: your name, email address, phone number, billing and shipping addresses, and the Founding Member tier or products you purchase.

  • Campaign onboarding details: the name you ask us to install on the Founders’ Wall, any optional bottle inscription name, event attendance responses, and guest names you provide for events.

  • Communications: messages you send us by email or through our website, and survey or form responses (including how you heard about us).

Information collected automatically: when you visit our website, our website platform (Wix) and its service providers may automatically collect device and usage information such as IP address, browser type, pages viewed, and cookie identifiers. See Section 7 (Cookies) below.

Payment information: payments are processed by our payment processors (such as Wix Payments). We do not receive or store your full card number; we receive confirmation of payment and limited transaction details.

3. How We Use Personal Information

  • To process pledges and orders, verify eligibility (including that you are 21 or older), and deliver perks — including installing your submitted name on the Founders’ Wall, producing your bottle inscription, shipping your Glencairn, and managing event guest lists.

  • To send transactional communications about your pledge, your onboarding form, schedule updates, and event details.

  • To send marketing communications about JTDC news, products, and the tasting room, which you can opt out of at any time (Section 8).

  • To operate, secure, and improve our website; to prevent fraud; and to comply with legal obligations, including alcoholic-beverage laws requiring age verification.

4. How We Share Personal Information

We do not sell your personal information, and we do not share it with third parties for their own marketing. We share personal information only with:

  • Service providers who help us run the business and act on our instructions — for example Wix (website, payments, email automations), Google (Forms and Sheets used for campaign onboarding), payment processors, shipping carriers, and vendors who fabricate the Founders’ Wall or produce perks (who receive only the information needed, such as wall names).

  • Professional advisors and authorities where required — for example our lawyers or accountants, or government agencies (including the California Department of Alcoholic Beverage Control) when the law requires it.

  • A successor business if JTDC is involved in a merger, acquisition, or sale of substantially all of its assets, in which case personal information may transfer as part of that transaction.

5. The Founders’ Wall and Publicity

If your Founding Member tier includes the Founders’ Wall, the name you submit will be displayed publicly in our tasting room and may appear in photographs, video, and marketing materials depicting the tasting room, as described in the Founding Member Terms & Conditions. We will not use your image or contact information for marketing testimonials without your separate consent. If you prefer a nickname, initials, or another display name on the wall, submit that name in the onboarding form.

6. Data Retention

We keep personal information for as long as needed to fulfill your pledge and perks, comply with tax, accounting, and alcoholic-beverage recordkeeping requirements, resolve disputes, and enforce our agreements. We then delete or de-identify it. Names installed on the physical Founders’ Wall remain displayed as described in the Terms & Conditions.

7. Cookies and “Do Not Track”

Our website uses cookies and similar technologies provided by our website platform for site functionality, analytics, and, where enabled, marketing. You can control cookies through your browser settings and any cookie banner presented on the site; blocking some cookies may affect site functionality. Our website does not currently respond to browser “Do Not Track” signals.

8. Your Choices

  • Marketing emails: you may opt out at any time using the unsubscribe link in any marketing email. We will still send transactional emails about your pledge and perks.

  • Access, correction, and deletion: you may contact us at the address in Section 11 to request a copy of the personal information we hold about you, ask us to correct it, or ask us to delete it. We will honor reasonable requests unless we need the information to fulfill your pledge or to meet a legal obligation.

9. California Privacy Rights

California Civil Code Section 1798.83 (“Shine the Light”) permits California residents to request certain information regarding disclosure of personal information to third parties for their direct-marketing purposes. JTDC does not disclose personal information to third parties for their own direct-marketing purposes. California residents may nonetheless submit inquiries to the contact address in Section 11.

10. Age Requirement and Children

Our website, products, and the Founding Member Campaign are intended for adults twenty-one (21) years of age and older. We do not knowingly collect personal information from anyone under 21, and our website is not directed to children under 13. If you believe a person under 21 has provided us personal information, contact us and we will delete it.

12. Changes to This Policy

We may update this Privacy Policy from time to time. We will post the current version on our website with a new effective date, and, for material changes, we will notify Founding Members by email. Your continued use of the website after an update means you accept the revised Policy.

13. Security

We use commercially reasonable safeguards — including the security features of our website, payment, and form providers — to protect personal information. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
